1. **Terms and Conditions**
These Terms and Conditions ("Terms") govern the use of photography services ("Services") provided by Ibrahima Diallo ("Photographer") to the booker ("Client"). By using our Services, you agree to these Terms.
2. **Scope of Services**
2.1. Photographer agrees to provide photography services as described in the agreed-upon contract or proposal.
2.2. Services may include, but are not limited to, portrait sessions, event coverage, editing, and delivery of digital or physical prints.
3. **Copyright and Usage Rights**
3.1. Photographer retains all copyright and ownership of the images created during the provision of Services.
3.2. Client is granted a non-exclusive license to use the images for personal or promotional purposes, including online and print media, with credit to the Photographer.
3.3. Client may not sell or transfer the images to third parties without the Photographer's written consent.
4. **Payment Terms**
4.1. Client agrees to pay the Photographer the agreed-upon fees for Services as outlined in the contract or invoice.
4.2. Payment is due [state payment terms, e.g., "upon receipt of invoice" or "50% deposit, balance due before day of photography shoot.
4.3. Late payments may incur additional fees or interest as specified in the contract.
5. **Cancellation and Rescheduling**
5.1. Client may cancel or reschedule a session by providing 60 days notice to the Photographer.
5.2. In the event of cancellation, any deposit or fees paid may be forfeited, as outlined in the contract.
6. **Liability**
6.1. Photographer is not liable for any damages, losses, or injuries incurred during the provision of Services, except in cases of gross negligence or willful misconduct.
6.2. Client agrees to indemnify and hold Photographer harmless from any claims or liabilities arising from the Client's use of the images.
7. **Dispute Resolution**
7.1. Any disputes arising from these Terms or the provision of Services shall be resolved through mediation or arbitration in [jurisdiction], governed by the laws of [jurisdiction].
8. **Changes to Terms**
8.1. Photographer reserves the right to modify these Terms at any time. Updated Terms will be communicated to Clients and posted on the Photographer's website.
By booking my photography services, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
